Acceptable Use Policy
Morgan Applied Technologies, LLC and its affiliates provide services to business and consumer users in several Information Technology areas. These area’s of service include such services as various electronic mail (email) packages, World Wide Web hosting arrangements, Blog Hosting and marketing arrangements, technology support and maintenance and other online and Internet-related services.
Morgan Applied Technologies, LLC reserves the right to refuse service to any individual, company or corporation. In addition, we reserve the right to suspend or terminate service to a client whose activities may be deemed detrimental to our client base. As a courtesy, we will attempt to contact our clients to notify the client of breach of the Acceptable Use Policy (AUP), herein referred to as AUP, so that appropriate corrections may be taken if applicable depending on the severity of the AUP breach.
It is contrary to Morgan Applied Technologies, LLC policy for any of these services to effect or participate in any of the following activities through an Morgan Applied Technologies, LLC provided source and will constitute a breach of the AUP:
Anti-Spam Policies
- It is contrary to Morgan Applied Technologies, LLC AUP to post five (5) or more messages of similar in content to Usenet or other newsgroups, forums, email mailing lists or other similar groups or lists.
- It is contrary to Morgan Applied Technologies, LLC AUP to post to any Usenet or other newsgroup, forum, email mailing list or other similar group or list articles to which are off-topic according to the charter or other owner published FAQ or description of the group or list
- It is contrary to Morgan Applied Technologies, LLC AUP to send unsolicited email to more than ten (10) email users, if such unsolicited email could reasonably be expected to provoke complaints.
Misuse of Services, Information, and Security Breaches
- It is contrary to Morgan Applied Technologies, LLC AUP to falsify user information provided to Morgan Applied Technologies, LLC or to other user of the service in connection with use of Morgan Applied Technologies service. Falsification of Information is grounds for immediate termination of all services and may result in forfeiture of existing paid for services and legal action against responsible parties.
- It is contrary to Morgan Applied Technologies, LLC AUP to engage in any of the foregoing activities by using the service of another provider, but channeling such activities through an Morgan Applied Technologies, LLC account, re-mailer, or otherwise through an Morgan Applied Technologies, LLC service or using an Morgan Applied Technologies, LLC account as a mail-drop for responses or otherwise using the services of another provider for the purpose of facilitating the foregoing activities if such use of another party’s service could reasonably be expected to adversely affect an Morgan Applied Technologies, LLC service. Misuse of Morgan Applied Technologies by deliberately trying to bypass existing security measures to prevent such activities will result in immediate termination and forfeiture of remaining paid for services.
- It is contrary to Morgan Applied Technologies, LLC AUP to use Morgan Applied Technologies, LLC services for illegal activities and activities harmful to others computers, data, software or networks including but not limited to hacker activities, virus creation and distribution, denial of service attacks, email bombs, and other similar harmful activities. Performing such activities is grounds for immediate termination, forfeiture of remaining paid for services, and legal action against responsible parties.
- It is contrary to Morgan Applied Technologies, LLC AUP to use our services to post any of the following noted items to the Internet. Posting such items is grounds for immediate account termination, forfeiture of remaining paid for services, and may require legal action against responsible parties.
- Copyright, trademark, patent, trade secret or other intellectual property infringement, including but not limited to offering pirate computer programs or links to such programs, serial or registration numbers for software programs, copyrighted music, copyrighted images; copyrighted texts etc. Please refer to the copyright resolution document for cases involving copyright infringement:
- Displaying material that exploits children under eighteen (18) years of age;
- Displaying material containing nudity or pornographic material of any kind.
- Providing material that is offensive to the online community, including but not limited to profanity, bigotry, prejudice, racism, hatred, etc.
- Promoting or providing information about illegal activities, promoting physical harm or injury against any group or individual, or promoting any act of cruelty to animals;
- Defaming any person or group;
- Promoting or soliciting for participation in multilevel marketing or pyramid schemes.
- Gathering personally identifiable information for unlawful purposes.
Addendum for Blog Contributors
Morgan Applied Technologies, LLC offers a service for individuals to create and contribute to an online blog on a specified topic.
Morgan Applied Technologies, LLC reserves the right to refuse service to any individual, company or corporation. In addition, we reserve the right to suspend or terminate service to a client whose activities may be deemed detrimental to our client base. As a courtesy, we will attempt to contact our clients to notify the client of breach of the Blog Acceptable Use Policy (BAUP), herein referred to as BAUP, so that appropriate corrections may be taken if applicable depending on the severity of the BAUP breach.
Policies:
- It is contrary to Morgan Applied Technologies, LLC BAUP to violate any of the regular AUP policies, especially those as noted in Part four (4) of the “Misuse of Services, Information, and Security Breaches”.
- It is contrary to Morgan Applied Technologies, LLC BAUP to deviate blog discussions from the normal range of blogging on the site except where deemed suitably related to the original content. The specific content that was originally stated in the contract binds the end user to continue on the same path due to complications relating to SEO Optimization, Sitemaps, and Marketing Work. Deviation from the original Contract requires a new contract to be formalized.
- It is contrary to Morgan Applied Technologies, LLC BAUP to take part in flaming. Flaming is defined as: a hostile and insulting interaction between Internet users.
- It is contrary to Morgan Applied Technologies, LLC BAUP to attempt to circumnavigate existing publishing restrictions and controls implemented on blog sites, such attempts will be treated as security breaches as noted under the AUP “Misuse of Service, Information, and Security Breaches”.
- It is contrary to Morgan Applied Technologies, LLC BAUP to utilize Morgan Applied Technologies, LLC web site content and / or images without expressed permission from Morgan Applied Technologies, LLC, doing so will constitute a breach of BAUP and a copyright infringement violation.
- It is contrary to Morgan Applied Technologies, LLC BAUP to utilize Morgan Applied Technologies, LLC for any purpose other than that stated in the original user agreement which describes blog content, use, and services.
Additional Agreements
Morgan Applied Technologies, LLC is located in New Jersey, however, our server is located in California and most of the associated equipment (including equipment used to provide mail services). California law has strict policies regarding unsolicited mail advertising among other items. As such, in the event that the law is breached, California law provides for liquidated damages, in the event that such is not complied with. These damages start at $25,000 per day. It is important to note unsolicited commercial email or SPAM will not be tolerated, users found in breach of this will be held liable for expenses incurred due to said breach.
Morgan Applied Technologies, LLC reserves the right to modify and update this document at any time during the course of a client’s subscription with the company. Morgan Applied Technologies, LLC will attempt to provide notice of any AUP or BAUP changes, the most current AUP and BAUP will be made available at https://www.morganat.com/acceptable-use-policy
Morgan Applied Technologies, LLC will not be construed or limited by anything contained in this policy. Morgan Applied Technologies, LLC reserves the right to take any and all actions or remedies deemed necessary by any of the foregoing activities, including without limitation taking action to recover costs and expenses of identifying offenders and removing them from Morgan Applied Technologies, LLC, services, levying cancellation charges to cover expenses. Morgan Applied Technologies, LLC reserves the right at all and any time in respect to remedies and activities at law or in equity.
